This “Planned Maintenance Agreement” will continue until terminated and may be terminated by either party upon 60 days written notice. The contractor may annually adjust any charges for ongoing maintenance or service abased on prevailing labor and material costs. A&G Services, Inc. shall not be held liable for any damages caused by obsolescence or acts of God or any special, incidental, or consequential damages resulting from the use of the equipment specified herein during the life of this agreement, nor be liable for any damages whatsoever occasioned by defective design, materials, operation, or malfunction of equipment which is designed by the owners instruction or specification. Service calls after completed seasonal inspections are subject to diagnostic fees.
